Professor John B. {{Surname|Eberly}} tried to hire Quincy {{Surname|Leckrone}}, but no deal was reached. The Smithville, Ohio citizens encouraged a independent school. At close of first day of classes Quincy Leckrone was issued an injunction barring him from further activities with this new school as he was under contract to teach at the {{Surname|Eberly}} School. Eberly lost the case and Mr. Leckrone resumed charge of the school.
